A Brooklyn man claims Ace Industries Construction and its senior manager are responsible for unpaid overtime and spread-of-hours wages.
A Brooklyn resident is behind a proposed collective and class action in which he claims Ace Industries Construction LLC and its senior manager failed to pay proper wages in violation of the Fair Labor Standard Act (FLSA). According to the complaint, the plaintiff worked for the defendants as a laborer in November and December 2016. During that time, the plaintiff worked between 45 and 60 hours per week without being paid time-and-a-half overtime wages, the lawsuit says. Moreover, the plaintiff frequently worked upward of 10 hours per day without being paid spread-of-hours premiums owed under state labor law, according to the suit. The plaintiff says he frequently complained to the defendants’ managers about errors on his paystubs, but to no avail.
