A proposed class action alleges All Star Limousine Service has failed to properly pay its drivers for all hours worked.
From New York comes a proposed class action that alleges All Star Limousine Service, Ltd. fails to pay its drivers proper overtime wages. The plaintiff, who the case says worked for the defendant from July 2005 through July 2017, claims that from the beginning of his employment through August 11, 2014, he was not paid for all hours worked, and was compensated by the All Star Limousine Service based on the number of hours the company estimated it would take to complete a trip. The plaintiff claims that, from August 2014 through the end of his employment, he was paid time-and-a-half overtime, but that the calculation of these wages did not include commissions. All told, the plaintiff alleges he worked between 50-60 overtime hours per week without proper pay under the Fair Labor Standards Act (FLSA).
Moreover, the plaintiff asserts that he paid roughly $25,000 to $30,000 to cover vehicle damages during his tenure with the defendant without reimbursement, and was not repaid for parking fine deductions, the case says.
