Moderno v. Alines' American, Inc. et al
Filed: June 19, 2018 ◆§ 1:18cv3566
A former parking attendant claims the used car dealership failed to pay proper overtime wages.
New York
Alines’ American, Inc. and its owner are the defendants in a proposed collective action over the used car dealership’s alleged failure to pay time-and-a-half overtime wages under state and federal labor laws.
The plaintiff claims he worked for Alines Auto Group as a parking attendant from April to May 2018. According to the case, the man put in no fewer than 55 hours per week for $12 per hour without being paid time-and-a-half overtime for every hour worked past 40. The suit says that when the plaintiff complained to the individual defendant about the lack of overtime pay, he was told that employees simply did not receive overtime wages.
“Immediately thereafter, in May 2018, [the plaintiff] was terminated by Defendant Aline as a proximate result of and in response to his complaint,” the case claims.
