A former employee has filed a proposed class action against Adventure Tires 3, LLC and an individual with day-to-day control over the business to recover allegedly unpaid overtime wages.
A former employee has filed a proposed class action against Adventure Tires 3, LLC and an individual with day-to-day control over the business to recover allegedly unpaid overtime wages. According to the complaint, the plaintiff worked as a mechanic for the defendants from March 2015 through April 2018. The man claims he put in an average of 51 hours per week but was not paid appropriate overtime wages for 11 hours worked over 40 each week as required by the Fair Labor Standards Act (FLSA).
The lawsuit concedes in a footnote that the plaintiff was paid some overtime for some hours worked past 40 each week but was allegedly not paid “for hours worked ‘engaged to be waiting off the clock.’”
