Florida company Advance Case Parts, Inc. and two individuals are the defendants in a lawsuit filed over allegedly unpaid time-and-a-half overtime wages.
Coral Springs, Florida supermarket refrigeration supply and repair company Advance Case Parts, Inc. and two individuals with control over the business are the defendants in a proposed class action lawsuit filed over allegedly unpaid time-and-a-half overtime wages. Brought by an individual who worked as a service technician for the defendants from September 2015 through August 2017, the lawsuit claims the plaintiff was told at the time he was hired that his weekly worktime would not exceed 40 hours. Throughout his tenure with the defendants, however, the plaintiff alleges he worked between 50 to 80 hours per week during “just about each and every workweek.”
The plaintiff further alleges that he, on a weekly basis, submitted accurate log sheets to the defendant detailing the hours he worked. The defendants “regularly and intentionally” erased anywhere from between five to as many as 30 work hours from these log sheets, the lawsuit claims.
“When it came time to get paid, [the plaintiff] almost always noticed that he was paid for significantly less hours than he actually worked, as a way for [the defendants] to avoid paying overtime wages, and was routinely not paid overtime wages for hours worked over 40 in a workweek,” the case argues.
