Marketsource Inc. (Maryland) is the defendant in another wage and hour lawsuit, this time filed by a former account representative who claims the company owes employees unpaid overtime wages.
Marketsource Inc. (Maryland) is the defendant in another wage and hour lawsuit, this time filed by a former account representative who claims the company owes employees unpaid overtime wages. According to the suit, the defendant misclassified its account representatives as exempt from overtime wages until November 2016, when it determined that they should be reclassified as hourly, non-exempt employees.
“Although Marketsource may have paid some overtime compensation to the Account representatives from on or about November 2016 to the present,” the complaint alleges, “its procedures and pay practices also precluded Account Representatives from being able to record and report ALL their overtime hours, and encouraged Account Reps to work off the clock.”
Further, the suit argues that the defendant failed to include employees’ bonuses when determining their regular rates of pay for overtime calculations and refused to pay prior overtime hours incurred before November 2016.
