Hempstead, NY's A&M Discount Furniture is facing a proposed class action that claims it owes unpaid minimum and overtime wages.
A former store helper and delivery worker claims in a proposed collective action that A&M Discount Furniture and its owner should be on the hook for unpaid minimum, overtime, and spread-of-hours wages. Filed in New York, the complaint notes the plaintiff allegedly worked 53.5 hours per week and was paid a flat cash rate without being paid time-and-a-half overtime for the additional 13.5 hours of over-40 work time each week. The case notes the plaintiff was underpaid more than $250 for each workweek. Even further, the case alleged the plaintiff was never paid more than $750 owed for his final week of employment before his termination in February 2017.
On top of these wage and hour allegations, the lawsuit alleges A&M converted the plaintiff’s contributions for Social Security benefits, unemployment insurance, and Medicare for their own use.
