Borrero et al v. AAA Towing & Recovery, LLC et al
Filed: August 1, 2017 ◆§ 1:17-cv-22896-RNS
Two former tow truck drivers claim in a proposed class action that M.I.A. Towing & Recovery owes unpaid minimum and overtime wages.
Florida
From Florida comes a proposed class action alleging AAA Towing & Recovery, LLC, which operates as M.I.A. Towing & Recovery, and one individual with control over the business owe unpaid minimum and overtime wages. The plaintiffs, who worked for M.I.A. as tow truck drivers for a little more than 30 weeks in 2016 and resigned from their jobs on the same day, allege they were hired with the promise of being paid 30 percent of every service job performed. This arrangement was never honored by the defendant, the case claims.
One plaintiff claims he worked an average of 13 hours per day, while the other says in the suit he ended up working 12-hour days without being paid mandatory minimum or time-and-a-half over-40 overtime wages. Moreover, the men claim they complained about the lack of proper pay many times without success. The case alleges neither man was paid at all for his last week of employment.
