Bunting v. A to Z Wiring, LLC et al.
Filed: November 1, 2017 ◆§ 5:17-cv-00525-JSM-PRL
A former employee claims A to Z Wiring and RWL Communications owe back wages to telecomm installers misclassified as independent contractors.
Florida
A proposed class action filed in Florida claims defendants A to Z Wiring, LLC and RWL Communications, Inc. owe unpaid back wages to telecommunications installers who the complaint alleges were misclassified as independent contractors, not as employees. The plaintiff, who the case says worked for the defendants from early 2016 through August of that year, says he routinely worked more than 70 hours per week without time-and-a-half overtime pay. The case then claims the defendants, to further convolute their per-job pay structure, docked wages from the plaintiff and proposed class members over bogus customer complaints, particularly when a worker would earn a certain amount of money. Moreover, the lawsuit claims the defendants owe the plaintiff unpaid wages for mileage driven for work purposes, as well as reimbursement for requiring the plaintiff to provide his own tools and transportation. Lastly, the case alleges the defendants withheld the plaintiff’s final two paychecks and never paid workers for approximately four weeks of training.
