Weis Markets, Inc. is facing a lawsuit filed by an employee who claims the defendant fails to hire or promote African American individuals in favor of Caucasian workers while fostering a hostile work environment for African American employees. The plaintiff in the case is an African American who has worked as a selector/equipment operator at the defendant’s Milton, Pennsylvania warehouse since 2012. The man claims he has been “repeatedly passed over for promotion and set aside for favored Caucasian employees” despite being better qualified for the open positions. In fact, the case argues, the defendant’s discrimination is evidenced by “the racial imbalance of [the company’s] workforce, management, and supervisory staff.”
The complaint then delves into a series of events during which the plaintiff was allegedly exposed to racial discrimination by his coworkers, including supposedly being subjected to racially derogatory language. In one instance, a co-worker “nearly hit him with the work equipment she was operating,” the case attests, but the defendant allegedly refuses to adequately discipline the offending employees or address the situation.
The plaintiff claims he in October 2017 met with two management employees who asked him “what he wanted them to do about his complaints of racial discrimination.” Despite offering several potential solutions, the plaintiff was allegedly ignored, according to the complaint, as the supervisors “disregarded [his] suggestions, changed the subject, and left the meeting with no resolution.”
