California
A proposed class action recently removed to federal court in California alleges that Wayfair LLC has violated a slew of state labor laws related to overtime pay, meal and rest break premiums, and the timely remittance of wages.
According to the lawsuit, the plaintiff, a former hourly employee, was not paid all regular and overtime wages due. Additionally, the case says the woman was denied appropriate meal and rest periods, as well as premium pay for missed breaks. The plaintiff goes on to claim she was not reimbursed for business expenses, did not receive accurate wage statements and was not paid her wages in full upon separation of employment. All told, the case says Wayfair owes a proposed class of current and former employees up to about $8 million in unpaid wages and damages.
