Former waste disposal drivers have filed a class action against Republic Services, Inc. claiming they and proposed class members nationwide are owed overtime wages.
Former waste disposal drivers have filed a class action against Republic Services, Inc. claiming they and proposed class members nationwide are owed minimum and overtime wages under the Fair Labor Standards Act (FLSA). The lawsuit claims Republic Services willfully violated the FLSA by encouraging waste disposal drivers to handle pre- and post-shift work duties off the clock without pay.
The plaintiffs named in the complaint, who worked out of the defendants’ facilities in Texas, claim they regularly worked more than 40 hours per week without being paid overtime or without being given mandatory 30-minute meal breaks (even though this money was deducted from drivers’ pay). Instead of overtime pay, the lawsuit notes, the drivers were subject to “incentive pay plans,” which were a combination of day rates, piece rates and hourly rates.
