WARN Act Class Action Lawsuit Filed in Wake of USLS Mass Layoff in June 2024

The 10-page suit alleges Ten Oaks Management and TOG FAS Holdings, which own the transportation and logistics provider, ran afoul of the federal Worker Adjustment and Retraining Notification (WARN) Act when they terminated the plaintiffs and approximately 2,000 other employees on June 20 of this year without cause and without giving proper advance notice.
In addition, the class action lawsuit contends that the defendants neglected to provide USLS workers with 60 days’ worth of wages, salary, commissions, bonuses and accrued holiday and vacation pay following the layoff, in violation of the WARN Act. According to the case, the companies also failed to make 401(k) contributions and provide workers with health insurance coverage and other benefits during the 60 days post-terminations, as required by law.
The filing asserts that as a result of the alleged WARN Act violations, the plaintiffs and other former employees are entitled to recover 60 days’ compensation and benefits from the defendants.
As the complaint tells it, Ten Oaks Management’s executive operating partner, Andrew Lovrovich, announced the “immediate closure of USLS” during two conference calls with the logistics company’s upper management and facility managers on June 20. Reports say USLS filed for Chapter 7 bankruptcy the next day.
The USLS WARN Act lawsuit looks to represent anyone who worked at the company’s facilities, including those in Atlanta, Georgia, or Humble, Texas, and was terminated as part of or as the reasonably foreseeable result of a mass layoff ordered by the defendants on June 20, 2024 and thereafter.
