Monster Chef Inc., which does business as Vines Grille & Wine Bar in Florida, and its owner are the defendants in a proposed class action.
Monster Chef Inc., which does business as Vines Grille & Wine Bar in Florida, and its owner are the defendants in a proposed class action alleging wait staff earned well below the federal mandatory minimum wage and were unlawfully forced to share tips with non-wait staff. Under the Fair Labor Standards Act (FLSA), employers are allowed to use a portion of workers’ earned tips to hit minimum wage benchmarks so long as the tipped employees are notified that this tip credit will be exercised and they’re allowed to keep all tips receive outside of a valid tipping pool. The named plaintiffs in the suit claim they made far less than the hourly minimum wage and were forced to pay portions of their tips to management and/or band performers and were insufficiently notified that their employer would be taking advantage of the FLSA tip credit provision.
