Transporter Services, Inc. claims the company failed to pay its drivers proper minimum and overtime wages while making improper deductions from the workers’ paychecks to cover vehicle insurance costs. Filed in Florida, the complaint asserts the defendants “willfully, uniformly, and unilaterally” misclassified proposed class members as independent contractors even though a clear employer-employee relationship existed between the parties. By misclassifying drivers as independent contractors and not employees, the suit continues, the defendant allegedly saved money on taxes and wages, as well as gained a competitive advantage in the marketplace.
