Santiago et al v. Church Avenue Express Inc. et al
Filed: March 14, 2018 ◆§ 1:18cv1594
Two companies and two individuals who own and operate Church Avenue Car Service have been named in a proposed collective action that alleges the defendants failed to pay dispatchers proper minimum and overtime wages.
New York
Two companies and two individuals who own and operate Church Avenue Car Service have been named in a proposed collective action that alleges labor law violations. The four named plaintiffs say they worked as dispatchers for the defendants in excess of 40 hours per week without receiving applicable minimum and overtime wages. Two of the plaintiffs were paid hourly and the other two were paid per shift, according to the suit, but their wages allegedly failed to meet minimum wage requirements and failed to include time-and-a-half overtime pay. On top of that, the case alleges that some employees’ paystubs were adjusted to reflect fewer hours than they actually worked.
The complaint further argues that employees were not provided with proper meal breaks or accurate wage statements in accordance with state law.
