ECM Energy Services, Inc. is the defendant in a class action claiming the oil industry logistics and fracking company failed to pay workers proper overtime.
ECM Energy Services, Inc. is the defendant in a class action claiming the oil industry logistics and fracking company failed to pay workers at natural gas well sites in western Pennsylvania acceptable overtime wages under the Fair Labor Standards Act (FLSA). The lawsuit alleges class members were assigned to work at well sites in at least three states from a centralized main office. Even though class members reportedly worked 12-hours shifts six days a week, they were paid at a flat $140 per day rate regardless of how many hours over 40 they worked in a week.
The complaint notes that the defendant was subject to a 2014 U.S. Department of Labor investigation over unpaid overtime wages, and investigated again in 2016 over the same transgression. After the inquiries, the defendant purportedly agreed to comply with FLSA overtime statutes, but has still failed to pay proper overtime wages.
