Unpaid Wage Lawsuit Against FedEx Ground Package System Lands in CA’s Northern District

Two former employees claim FedEx Ground failed to pay employees for all hours worked, including time spent on off-the-clock security checks.
A proposed wage and hour collective action filed against FedEx Ground Package System, Inc. by two former employees has been removed from the U.S. District Court for the Central District of California to the state’s Northern District. The complaint charges that FedEx failed to pay members of the proposed collective at least the minimum wage, which allegedly stems from the defendant’s failure to pay for all hours worked. For instance, the plaintiffs claim they and other workers had to wait without pay in off-the-clock security checks conducted before entering and exiting the warehouse.
The plaintiffs, who respectively worked as a warehouse package handler and parcel sorter, further claim FedEx failed to timely pay wages to members of a proposed “waiting time” subclass who were terminated from or willfully left their employment.
