A former family service counselor has filed a proposed class action against CMS Mid-Atlantic, Inc. and its owners claiming he and others were never paid proper overtime.
A former family service counselor has filed a proposed class action against CMS Mid-Atlantic, Inc. and its owners claiming he and proposed class members were never paid rightful time-and-a-half overtime wages. Filed in New Jersey, the lawsuit claims the plaintiff regularly worked between 52 and 60 hours or more each week at a cemetery without meal breaks or proper overtime pay. After the plaintiff complained to his manager about the lack of overtime pay, he was allegedly retaliated against by receiving “worse job assignments” and fewer opportunities to earn commissions before being terminated.
