A proposed collective action alleges Anheuser-Busch InBev subsidiary Anheuser-Busch, LLC (AB) failed to pay certain workers proper overtime wages in violation of the Fair Labor Standards Act (FLSA). The 10-page lawsuit was filed in California where the plaintiff was employed at AB’s Solano County facility.
The plaintiff, who worked for the defendant from April through August 2015, claims the defendant employs a policy of compensating employees only for their scheduled hours, and not for the hours they actually worked. The individuals’ true total work hours, the complaint alleges, are regularly greater than their scheduled hours since Anheuser-Busch knows, permits, and sometimes requires that worked be performed off the clock. This practice allegedly deprives proposed collective members of rightful time-and-a-half overtime wages for all hours worked over 40 in a week.
