A proposed class action filed on behalf of current and former UnitedHealthcare, Inc. case managers claims the employees routinely denied overtime wages.
A proposed class action filed on behalf of current and former UnitedHealthcare, Inc. case managers claims the employees routinely worked more than 40 hours per week without being paid at the mandatory time-and-a-half hourly overtime rate. The lawsuit, filed in New Mexico district court, says the employees routinely worked overtime—and were directed to do so—and were not paid at the time-and-a-half hourly rate as defined by the Fair Labor Standards Act (FLSA), instead receiving a flat salary regardless of how many hours were worked. According to the plaintiff, the defendant “willfully” misclassified proposed class members as exempt from overtime pay, and continued with its non-payment of overtime despite routine receiving complaints from workers.
