New York’s Umi Sushi and its owner are facing a proposed class action over alleged violations of the Fair Labor Standards Act (FLSA) with regard to paying workers proper overtime wages. Filed by a former sushi chef, the lawsuit claims the plaintiff and similarly situated workers were not paid at the time-and-a-half hourly rate for all hours they worked over 40 in a workweek. Additionally, the lawsuit claims proposed class members were not paid spread-of-hours wages for shifts lasting longer than 10 hours in a day as required under New York labor laws.
