Ulta Named in Unpaid Wage Class Action in California

A proposed class action lawsuit recently removed from superior to district court in California details a former Ulta employee’s allegation that the beauty product retailer has failed to pay proper wages, among other alleged labor infractions.
Filed against Ulta, Inc. and Ulta Salon, Cosmetics & Fragrance, Inc., the lawsuit states the plaintiff and similarly situated employees were subject to illegal meal and rest break policies under which they were required to work through meal and break periods without compensation. The case specifies that for missed meal periods, California law stipulates workers are owed an additional one hour of compensation at their regular rate for each workday in which a meal break was not provided.
Per the case’s second count, the plaintiff claims Ulta similarly failed to remit to workers one additional hour of compensation at their regular hourly rate per workday in which a rest period was not provided. Further still, the suit alleges the hours for which Ulta employees worked through meal and rest breaks were incorrectly tallied, resulting in work time that should have been compensated at a time-and-a-half overtime rate for those who worked upward of 40 hours in a given workweek.
The suit rounds out with the claim that Ulta has failed to pay all accrued wages to former workers within 72 hours of the end of their employment.
