Trustco Bank, a Federal Savings Bank, is on the wrong end of a proposed class action lawsuit filed by former tellers who claim they were not paid proper overtime wages.
Trustco Bank, a Federal Savings Bank, is on the wrong end of a proposed class action lawsuit filed by former tellers who claim they were not paid time-and-a-half overtime wages as required by the Fair Labor Standards Act (FLSA). The plaintiffs also allege they and proposed class members were not paid for time spent opening and closing the bank’s facilities and were frequently required to use their lunch break time to travel to other branch locations, even though that time was still deducted from their pay. Further, the defendants allegedly manipulated employee time records as means to avoid the workers accruing more than 40 hours of work time in any given week.
