Three individuals formerly employed by a Birmingham, Alabama Tilted Kilt restaurant have filed a proposed class action over numerous alleged wage and hour violations. The lawsuit begins by claiming that the defendant, BAL TK, LLC, unlawfully denied tipped workers their proper wages when it took an illegal tip credit to which the company was not entitled. Further, the case claims the defendant failed to properly compensate workers for time spent putting on and removing their employer-mandated uniforms, which workers had to pay for themselves. The alleged actions outlined in the complaint, the three named plaintiffs say, amounted to the non-payment of mandatory minimum wages for current and former tipped employees.
