A proposed class action filed against Target Corporation over alleged California labor law violations has been reassigned from a magistrate judge to a district court judge in the state’s Oakland division.

A proposed class action filed against Target Corporation over alleged California labor law violations has been reassigned from a magistrate judge to a district court judge in the state’s Oakland division.
Behind the case is a former non-exempt employee who claims her hourly rate fell below her agreed-upon pay rate because she was not reimbursed for business expenses, including the cost of using her personal cell phone for work purposes and purchasing required uniforms. According to the lawsuit, when customers wanted a price match, the plaintiff and other employees were required to use their cell phones on the job to compare product costs. Additionally, the case says, Target instructed workers to wear red shirts and beige pants, which they allegedly paid for out of pocket. As a result, the suit continues, employees’ work expenses shorted them on pay and deprived them of proper minimum and overtime wages.
Moreover, the case alleges the defendant furnished inaccurate written wage statements with false information, including hours worked and net income, and failed to timely pay employees’ final wages after termination or resignation.
