The owner of New York-based restaurant Tacos Al Suadero has been named as a defendant in a lawsuit filed by a former employee who claims he is owed unpaid wages.
The owner of New York-based restaurant Tacos Al Suadero has been named as a defendant in a lawsuit filed by a former employee. The plaintiff – who was hired to stock shelves, prepare food, and make deliveries – claims the defendant violated the Fair Labor Standards Act and New York state law by failing to pay him proper wages, permit him to take required breaks, and provide him with accurate wage statements.
According to the complaint, the plaintiff worked an average of 72 hours per week and was paid at a fixed weekly rate. The suit argues that he should have been paid overtime wages for the weekly hours he worked above 40 and that he is owed an extra hour’s pay for each shift he worked that lasted longer than 10 hours. In addition, the plaintiff says his pay fell below the required minimum wage.
The complaint further claims that the plaintiff and similarly situated employees were never permitted to take breaks of any kind and that the defendant neglected to provide them with accurate wage statements that detailed their hours and rates of pay.
