Business outsourcing and call center companies Sykes Enterprises, Inc. and Alpine Access, Inc. are the subject of a class action lawsuit over alleged Fair Labor Standards Act violations. The plaintiff, a former education agent and hourly work-from-home customer service rep, says she regularly performed off-the-clock work without receiving proper minimum or overtime wages, as well as promised bonuses and other rewards.
The suit specifically claims the plaintiff was never compensated for pre- and post-shift job activities, such as booting up and logging into her computer and time spent wrapping up customer phone calls after she had already clocked out. The plaintiff claims her supervisors told her she would be paid for these activities in a future paycheck, but never was reimbursed by the defendants.
Furthermore, the plaintiff says she won an Apple iPad in an employee drawing, but the defendants withheld employee taxes from her paycheck based on the value of the device.
