A current truck driver for Knight Transportation, Inc. has filed suit against the company over claims that his employer misclassified employees as independent contractors and excluded them from participating in employee benefit plans.
A current truck driver for Knight Transportation, Inc. has filed suit against the company, its 401(k) plan, its cafeteria plan, and their administrative committees over claims that the parties misclassified employees as independent contractors and excluded them from participating in employee benefit plans. According to the suit, Knight truck drivers are subject to the company’s various policies and procedures and are not provided the freedom to make independent business decisions. Because Knight controls “virtually all aspects” of their work, the complaint claims, truck drivers should be classified as employees and permitted to participate in the aforementioned employee benefit plans.
