A class action filed on behalf of individuals employed as sales managers claims Stonemor Partners L.P. failed to pay proper overtime compensation under the Fair Labor Standards Act (FLSA) and Pennsylvania labor law. The lawsuit alleges the plaintiff and those similarly situated were misclassified as exempt from overtime pay and often worked between 55 and 70 hours per week without being paid time-and-a-half. Despite their titles, proposed class members claim they did not engage in managerial job duties or have the authorities typically given to managers, such as the power to hire and fire workers, make alterations to employee benefit forms or purchase office supplies without approval.
