El Castillo De Las Frutas II, Corp and its owner are the defendants in a class action filed over allegedly unpaid overtime and minimum wages. The plaintiff, a former kitchen helper, claims his former employer violated terms of the Fair Labor Standards Act (FLSA) by failing to pay employees at the time-and-a-half hourly rate for all hours worked over 40 in a week. According to the complaint, the plaintiff often worked an average of 69 hours per week without receiving the proper overtime rate.
