The operating company of St. Petersburg, Florida restaurant Skyway Jack’s, JTNU, Inc., and its owner are the defendants in a proposed class action filed over allegedly unpaid minimum wages. The plaintiff, who worked for the defendants from August through December 2016, alleges she and similarly situated hourly servers were paid pursuant to an illegal tip credit method, which resulted in the employees being paid below the federal minimum wage.
The case alleges the defendants unlawfully failed to fulfill certain provisions of the Fair Labor Standards Act (FLSA) that permit the tip credit method of payment, namely that tipped workers be allowed to keep all their tips individually or through a valid tip pool. The plaintiff claims the defendants engaged in the practice of deducting tips from servers’ wages to offset the business’ overhead costs, and “charged [the plaintiff] a fixed fee for every shift she worked.”
Even further, the plaintiff and proposed class members were allegedly forced to work off the clock for “up to 20 hours each week.”
