Sirius XM, Pandora Failed to Reimburse Business Expenses, Provide Complete Wage Statements, Lawsuit Alleges

Potts v. Sirius XM Radio Inc. et al.
Filed: December 17, 2021 ◆§ 2:21-cv-09755
A lawsuit claims Sirius and Pandora have failed to properly reimburse employee business expenses and provide complete wage statements.
California
A proposed class action lawsuit claims Sirius XM and Pandora Media have failed to properly reimburse employee business expenses and provide complete wage statements in accordance with California law.
The plaintiff, who worked as an office manager for the defendants’ western region, alleges the media companies have violated California’s Labor Code and Unfair Competition Law.
According to the case, Sirius XM and Pandora have failed to fully reimburse employees for the necessary out-of-pocket expenses they incurred while performing their job duties, including the costs of internet service; phone hardware, service, related equipment (such as routers and USB cables); chairs, work surfaces and work area lighting; and the use of a workspace and utilities.
The suit further alleges the defendants routinely failed to provide employees with complete wage statements in accordance with the California Labor Code. Per the complaint, the wage statements omitted “important address information,” namely the floor or suite number for the defendant’s mailing address. California law requires wage statements to contain, among other items, an employer’s full name and address, according to the case.
The lawsuit alleges these practices have allowed Sirius XM and Pandora to gain an unfair advantage over competitors who’ve attempted to comply with applicable wage and hour laws.
The case, which was initially filed in Los Angeles County Superior Court before being removed to California’s Central District Court on December 17, 2021, looks to represent anyone who is or was employed by SiriusXM or Pandora in California at any time between four years before the lawsuit was filed and the present.
