Sid’s Sealants and its owner are the defendants in a proposed class action filed in Wisconsin over claims that workers were not paid time-and-a-half overtime wages under the Fair Labor Standards Act (FLSA). The plaintiff, a former caulker and insulator for the defendants, claims he and similarly situated employees often worked more than 40 hours a week at their regularly hourly pay rate without being paid the time-and-a-half rate required by the FLSA for all hours worked past 40 in a week.
On top of the suit’s claims of wage and hour violations are allegations that the defendants frequently undercut the number of hours worked by proposed class members. Specifically, the suit notes, the defendants allegedly “did not count as hours worked time spent by the plaintiffs receiving their work assignments, helping to load the company truck, or their subsequent drives to the first jobsite for the day.” Similarly, the lawsuit says workers were not paid for time spent at the end of work days traveling to the company shop from the jobsite, emptying out trailers and barrels and engaging in other work-related duties.
Lastly, the suit claims employees who had to work at jobsites in other states were not paid for time spent traveling back home either at the beginning or end of the workweek, as the defendant did not count these hours as time spent working.
