Nabala et al v. New Horizon Security Services, Inc. et al
Filed: April 4, 2017 ◆§ 1:17-cv-00406-AJT-JFA
New Horizon Security Services, Inc. and its owner are the defendants in a proposed class action filed by two employees who worked for the company as security guards.
New Horizon Security Services, Inc. and its owner are the defendants in a proposed class action lawsuit filed by two former employees who worked for the company as security guards. The lawsuit alleges that New Horizon failed to pay its employees proper time-and-a-half overtime compensation for hours worked above 40 in a week, as mandated by the Fair Labor Standards Act (FLSA). One of the plaintiffs claims he is owed over $10,000 in unpaid wages. Additionally, the plaintiffs argue that they were denied the promised $281 deposit they should have received for returning their uniforms.
According to the suit, “Defendants’ failure and refusal to pay Plaintiffs the proper wages for overtime hours worked as required by the FLSA was willful and intentional.” It further claims the plaintiffs and other proposed class members were “explicitly and willfully misinformed” about their rights to proper compensation.
The proposed class includes current and former employees who worked for the defendants in Virginia at any time between January 1, 2014 to the present and did not receive FLSA-required overtime wages.
