One hundred and nineteen firefighters have put their names on a proposed collective action against the city of Santa Rosa, California.
One hundred and nineteen firefighters have put their names on a proposed collective action against the city of Santa Rosa, California that claims the city unlawfully failed to include all statutorily required forms of compensation when calculating the workers’ regular hourly pay rates for the purpose of calculating overtime. Citing alleged Fair Labor Standards Act (FLSA) violations, the lawsuit claims the defendant utilized an illegal compensation calculation method that undercounted the firefighters’ regular hourly rates of pay. As a result, the individuals were not paid their rightful hourly overtime wages, the suit claims.
The lawsuit seeks to cover current and former employees of the City of Santa Rosa who worked overtime and received holiday in lieu or sick leave incentive program payments between June 30, 2013 and the present. It is believed holiday in lieu and sick leave pay were not included in the calculation of proposed collective members’ regular hourly pay rates.
