Hilton Grand Vacations Company, LLC; Hilton Grand Vacations Management, LLC; Hilton Resorts Corporation; and Park Hotels & Resorts, Inc. are the defendants in a proposed class action lawsuit that alleges they failed to pay their employees proper minimum and overtime wages. The four plaintiffs say they worked for the defendants as sales executives at the Anderson Ocean Club and Spa in Myrtle Beach, South Carolina. According to the complaint, they were paid at an hourly rate and received commissions from selling timeshares. When they earned commissions, however, their previously paid hourly and overtime wages were treated as a “draw” and deducted from their commissions, the suit says. It further argues that when they did not earn a commission, their regular pay fell below the required minimum wage.
The plaintiffs also claim that they were not paid proper overtime wages. When their weekly hours approached 40, they were allegedly forced to clock out and continue working without being compensated for their time.
