A proposed class action has been filed in Florida against Carrabba's Italian Grill, LLC and its parent company, that claims the defendants misclassified their employees.
A proposed class action has been filed in Florida against Carrabba’s Italian Grill, LLC and its parent company, that claims the defendants misclassified their restaurant managers as exempt employees and failed to pay them overtimes wages. The plaintiff claims she and the other managers perform mostly non-exempt duties, including greeting customers, serving, cooking, clearing tables, and cleaning. According to the complaint, she would routinely work more than 60 hours per week, but Carrabba’s failed to record her hours or pay her time-and-a-half overtime compensation for the hours she worked above 40.
The proposed class includes any exempt-classified restaurant manager or similarly situated employee who has worked for Carrabba’s between April 5, 2014 and the date of judgment in this action.
