White et al v. Reeder Chevrolet, Inc. et al (PLR2)
Filed: March 24, 2017 ◆§ 3:17-cv-00107
A lawsuit out of Tennessee alleges defendants Reeder Chevrolet, Inc., Quinlan Motors, Inc. and Quinlan Motors, LLC refused to pay lube technicians overtime wages.
A proposed collection action out of Tennessee alleges defendants Reeder Chevrolet, Inc., Quinlan Motors, Inc. and Quinlan Motors, LLC refused to pay lube technicians overtime wages in violation of the Fair Labor Standards Act (FLSA). The defendants maintain a “Quick Lube Center” at its GM/Chevy dealership and properly classifies highly trained, certified mechanics as exempt from FLSA overtime protections. Lube technicians working in the defendants’ Quick Lube Center—which is separate from its warranty repair operation—however, perform routine oil changes and tire rotations. These workers, the case alleges, were improperly classified as exempt from time-and-a-half overtime, as they “report to a Quick Lube manager and are not within the same chain-of-command as [the defendants’] service department technicians.”
