Railroad workers filed a lawsuit against their former employer, Railworks Track Services, Inc., claiming it failed to pay them overtime wages.
Railroad workers filed a lawsuit against their former employer, Railworks Track Services, Inc., claiming it failed to pay them overtime wages. The plaintiffs and proposed class members allegedly constructed and performed maintenance on railroads throughout Ohio and other states across the nation. They claim their employer paid them at an hourly rate for the time they spent traveling to each job site and working there, but did not compensate them for the time they spent driving back to their “home locations.” The suit argues that “[t]ime spent by an employee in travel as part of their principal activity, such as travel from job site to job site during the workday, is work time and must be counted as hours worked.” The plaintiffs regularly worked from 40 to 70 hours per week, but they were not paid time-and-a-half overtime wages for the hours they worked in excess of 40 each week, the complaint says.
