The nine-page lawsuit was filed by a former employee who claims he and other workers at PGI’s manufacturing facility in Muskogee, Oklahoma, were terminated on March 13 without cause or advance notice. The suit contends that the fuel tank and fuel systems manufacturer has violated the Worker Adjustment and Retraining Notification (WARN) Act, a federal law that requires employers to provide workers with at least 60 days’ advance written notice prior to a mass layoff or plant closure.
According to the case, the plaintiff and other employees at the Muskogee facility were given “no indication that [PGI] intended to close its doors” until 6 p.m. on March 13, when they reportedly received an email informing them of the plant’s permanent closure and their immediate termination.
The complaint charges that at the time of the mass layoff, no circumstances existed that would have exempted PGI from the WARN Act’s advance notice requirements.
As the filing tells it, former employees and the community alike have been impacted by the facility’s abrupt shutdown.
“The effects of [PGI’s] unceremonious layoffs on the Muskogee, Oklahoma community cannot be understated,” the case asserts. “The community will bear the brunt of [the defendant’s] transgressions.”
The lawsuit looks to represent any PGI employees who were terminated pursuant to a mass layoff or plant closing within 90 days of March 13, 2024.
