The 10-page lawsuit alleges that the company violated the federal Worker Adjustment and Retraining Notification (WARN) Act when it terminated more than 230 employees on August 30 of this year without cause and without providing them at least 60 days’ advance written notice.
According to the suit, Volato on August 30 emailed workers a “formal notice” of their termination, effective that same day.
In addition, the defendant has breached the WARN Act by failing to provide former employees 60 days’ worth of wages, salary, commissions, bonuses and accrued holiday and vacation pay after their terminations, the case charges.
The complaint asserts that Volato has likewise neglected to make 401(k) contributions and provide medical coverage and other employee benefits in the 60 days following the layoff, as required by federal law.
Reports cite the company’s recent financial straits as the impetus for last month’s mass layoff.
The Volato lawsuit looks to represent anyone who worked at or reported to the company’s facility and was laid off without cause by the defendant as part of, or as the reasonably foreseeable result of, a mass layoff ordered by Volato on August 30, 2024, and who was not provided with the required advanced notice of the termination.
