A proposed class action has been filed in New York against BFY Brands, Inc. in which the plaintiff claims the company’s Popcorners snack chip products are sold with unacceptable levels non-functional slack fill.
A proposed class action has been filed in New York against BFY Brands, Inc. in which the plaintiff claims the company’s Popcorners snack chip products are sold with unacceptable levels non-functional slack fill. According to the complaint, BFY’s packaging practices violate consumer protection laws in all 50 states and the District of Columbia.
Non-functional slack fill, the complaint explains, can be misleading to consumers with regard to the quantity of the product they’re buying. The complaint argues that the defendant’s packaging of its Popcorners product effectively tricks consumers into paying for air.
