A proposed class action claims defendants Petco Animal Supplies, Inc. and Petco Holdings, Inc. should be on the hook for allegedly unpaid time-and-a-half overtime wages. The lawsuit, filed in Massachusetts, alleges the defendants failed to pay workers employed as assistant store managers (and other employees in comparable positions) overtime for all hours worked over 40 in a workweek.
The plaintiff, who worked for the defendants from 2009 through 2015, claims he regularly worked in excess of 40 hours per week without being paid overtime. The lawsuit alleges the plaintiff, despite the inference of his job title, was unlawfully misclassified by the defendants as exempt from overtime pay.
