A former employee of Percepta, LLC and Ford Motor Company has filed a lawsuit against them, claiming she was falsely classified as an exempt employee.
A former employee of Percepta, LLC and Ford Motor Company has filed a lawsuit against them, claiming she was falsely classified as an exempt employee and was unlawfully denied overtime wages. According to the suit, the plaintiff worked as a “zone manager” at the defendants’ Melbourne, Florida location, and would routinely work approximately 50 hours per week. She says most of her job was customer service related, and that she was never responsible to manage or supervise other employees. However, the suit alleges that Percepta and Ford refused to pay her time-and-a-half overtime wages for the hours she worked above 40 each week because they claimed her position was exempt from the overtime requirements under the Fair Labor Standards Act. According to the complaint, the defendants’ failure to properly classify and compensate their employees was “intentional and willful.”
