Penn Bower, Inc. and its president are the defendants in a proposed collective/class action that claims employees were paid only some of their rightful overtime wages.
Commercial and office building contracting outfit Penn Bower, Inc. and its president are the defendants in a proposed collective and class action that claims employees were paid some, but not all, of their rightful overtime wages “in cash off the books” at amounts less than the time-and-a-half hourly rate required by the Fair Labor Standards Act (FLSA). Similarly, the plaintiff, who did manual labor for the defendants from August 2016 through January 2017, claims the defendants also failed to pay workers for time spent driving between the company’s location and work sites, as well as for loading and unloading tools and materials.
