The operating entity of Champion Parking and its owners are facing a class action lawsuit filed by a former parking attendant who claims he was not paid overtime.
The operating entity of Champion Parking and its owners are facing a class action lawsuit filed by a former parking attendant who claims he was not paid overtime under the Fair Labor Standards Act (FLSA) nor spread-of-hours wages. The plaintiff says he regularly worked between 57 and 63 hours per week without being paid at the time-and-a-half rate per hour required by the FLSA. Furthermore, the plaintiff claims he did not receive spread-of-hours pay for any day in which he worked more than 10 hours. According to the complaint, the plaintiff was often required to begin working 30 minutes prior to when his shift was scheduled to start without being paid for that extra time.
In addition to alleging wage and hour violations, the plaintiff claims he was discriminated against because of his age. The lawsuit argues that the defendants “repeatedly granted promotions, better hours, and better salaries” to younger workers who had less seniority that the plaintiff.
