The operators of approximately 30 Papa John's pizza franchises are the defendants in a proposed class action claiming delivery drivers are owed money.
The operators of approximately 30 Papa John’s pizza franchises are the defendants in a proposed class action claiming delivery drivers are owed money for costs associated with using their own vehicles to deliver food. The lawsuit, filed in West Virginia, claims that instead of defendants P.S. Management, Inc. PFC, Inc., P.S. II, Incorporated, and P.S. III, Inc. reimbursing proposed class members for the “reasonably approximate costs of business” from using their own delivery vehicles, the companies used a “flawed method” to determine reimbursement rates. The lawsuit claims this resulted in the drivers being repaid far less than “any reasonable approximation” of the expenses incurred during the course of their work for the defendants.
Additionally, the lawsuit claims delivery driver spend “at least 20 percent” of their work time performing non-tipped tasks, yet are paid below the minimum wage benchmark for all of their work time.
