The owning and operating entities of New York vegan restaurant Blossom Du Jour have been cooked with a class action over alleged wage and hour violations. The lawsuit claims individuals hired as tipped delivery workers were required to spend “considerable” amounts of their work days performing non-tipped, non-delivery-related tasks throughout the restaurant. The defendants allegedly did not pay these workers Fair Labor Standards Act-mandated minimum and overtime wages and reportedly took a tip credit to which the restaurant was not entitled. According to the case, the defendants wrongly classified the proposed class members as tipped delivery workers on their payroll even though the workers say they spent a good amount of their days—more than 20 percent—performing non-tipped tasks.
