Uliu-Personius v. JMFF LLC et al
Filed: January 13, 2017 ◆§ 1:17-cv-00287
JMFF LLC and its operators, who run Dorlan's Tavern & Oyster Bar in New York City, are the defendants in a proposed class action.
JMFF LLC and its operators, who run Dorlan’s Tavern & Oyster Bar in New York City, are the defendants in a proposed class action that alleges a proposed class of current and former servers were not paid proper minimum, overtime and spread-of-hours wages. According to the case, the defendants unlawfully took a tip credit (to which they were not entitled) on the plaintiff and proposed class members’ wages without their knowledge, all while forcing them to share tips with non-tipped employees, including bar managers. Further, the lawsuit claims the defendant charged private event customers a “service charge” that was never distributed in its entirety to service teams.
Lastly, the plaintiff alleges that upon complaining to the defendants about their allegedly illegal tipping practices, she was fired without reason.
